Warranty Terms

Art. 01

Beneficiary and scope

This warranty is granted by ROCEAN SAS and covers defects in materials and workmanship of ROCEAN products, under the conditions and limitations set out below.

The warranty is attached to the product and benefits its end-user owner, including where the product was acquired through a reseller or installation partner approved by ROCEAN. In such cases, the warranty remains fully applicable provided that installation was carried out in compliance with ROCEAN's execution drawings and technical specifications — whether installation was performed by ROCEAN, by the partner, or by a third party.

In the event of resale of the product by its first owner, transfer of the warranty for the remaining period is subject to ROCEAN's prior written consent.

Periods run from the date of delivery. Extended warranty options for commercial use are available upon request from ROCEAN.

Systems covered include: electronic, electrical, plumbing and thermodynamic components.

Covered components

The warranty covers the following original components:

Composite shell (gelcoat, fibreglass, resin)
Compressor, condenser and heating element
Fans
Main electronic control boards
Insulation cover
Temperature sensors
Pump
Control panel
Underwater lighting and switch
Original valves and pipework
Art. 04

What ROCEAN covers

At its discretion, ROCEAN will repair or replace, free of charge, any defective component that has been installed, used and maintained under normal conditions, within the applicable warranty period.

If repair or replacement is not feasible, ROCEAN may offer a replacement product of equivalent value to the original. Replacement parts may not be identical to the original parts; availability is subject to change.

All warranty work is carried out exclusively by an authorised technician appointed by ROCEAN. Any repair carried out without prior written approval from ROCEAN is not covered under warranty and results in the cancellation of the warranty for the component concerned. ROCEAN will not reimburse repair costs incurred without its authorisation. Once the product is no longer in its original delivery condition — for any reason — ROCEAN can no longer guarantee its performance or conformity, and the warranty ceases to apply.
Art. 05

Warranty on replaced parts

Any part replaced under warranty benefits from its own 2-year warranty from the date of replacement. This individual warranty does not renew the original standard warranty; the remaining period of the original warranty continues to run independently.

Art. 06

Warranty exclusions

General principle — alteration of original condition

  • Once the product has been modified, altered, disassembled, repaired or changed in any way whatsoever — by the Client, an installer, a technician or any third party — and is no longer in all respects identical to its condition at delivery, the warranty is cancelled in full and definitively, without compensation of any kind.
  • This rule applies regardless of the extent of the modification, who carried it out, or whether it is related to the defect reported.
  • Use of the product outside its intended scope — including any use that does not comply with ROCEAN's recommendations regarding water quality, frequency of use, chemical treatments or installation conditions — is treated as an alteration of the original condition and carries the same consequence.

Installation and third-party intervention

  • Unless an installation service has been expressly ordered and invoiced by ROCEAN, installation is carried out by the Client or their contractors, under their sole and full responsibility.
  • Installation not performed by ROCEAN or not in compliance with ROCEAN's execution drawings.
  • Any modification, repair or intervention by a third party not expressly authorised in writing by ROCEAN — the warranty is then wholly and definitively cancelled.
  • Use of spare parts, filters, valves, pipes or accessories not supplied or approved by ROCEAN.

Water quality and maintenance

  • Unsuitable water quality: pH outside the recommended range, excessive chlorine levels, corrosion, biofilm development.
  • Failure to carry out regular product maintenance in accordance with ROCEAN's recommendations.

Use and environment

  • Intensive use without subscribing to the appropriate professional maintenance options.
  • Unsuitable environment: excessive humidity, insufficient ventilation, absent or inadequate drainage.
  • Exposure to freezing temperatures without activating the pump's heating mode.
  • Thermal shock, structural overload or unauthorised modification of the product.

Physical damage and foreign objects

  • Damage resulting from the product being moved or transported by the Client or a third party not mandated by ROCEAN.
  • Introduction of objects (glasses, toys, foreign bodies) into the bath.
  • Presence of any liquid other than water in the bath.
  • Use of chemicals incompatible with composite materials (acetone, aggressive solvents, etc.).

External causes

  • Negligence or use contrary to ROCEAN's recommendations.
  • Fire, flood, lightning, theft, pests or insects.
  • Any force majeure event.
Art. 07

Claims procedure

For any warranty claim, contact ROCEAN within 14 days of discovering the defect. Please include:

  • order number and delivery date;
  • precise description of the defect;
  • photos or videos illustrating the issue.

Art. 08

Statutory guarantees — individual consumers

Independently of the commercial warranty above, every consumer client benefits from the following statutory guarantees, which apply by operation of law and cannot be reduced or excluded by contract.

Legal guarantee of conformity (art. L.217-3 et seq. of the French Consumer Code)

  • The consumer has 2 years from delivery of the product to take action. During this period, they need only establish the existence of the lack of conformity, not the date it appeared.
  • The guarantee entitles the consumer to repair or replacement of the product within 30 days of the request, free of charge and without major inconvenience.
  • If the product is repaired under the legal guarantee, the consumer benefits from a 6-month extension of the initial guarantee. If the seller imposes replacement, the legal guarantee is renewed for 2 years from the date of replacement.
  • The consumer may obtain a price reduction or termination of the contract (full refund against return) if repair or replacement is refused, takes place after 30 days, causes major inconvenience, or if the lack of conformity persists. They are not entitled to termination if the defect is minor.
  • Any period during which the product is immobilised for repair or replacement suspends the remaining guarantee period.

Legal guarantee against hidden defects (art. 1641 et seq. of the French Civil Code)

  • The consumer may take action for hidden defects within 2 years of discovering the defect.
  • This guarantee entitles the consumer to a price reduction (product retained) or a full refund against return of the product.

To invoke a statutory guarantee, the product must be returned in the condition in which it was received, with all its components, together with a copy of the purchase invoice. These statutory guarantees are independent of the ROCEAN commercial warranty and of the right of withdrawal.

Art. 09

Governing law

This warranty is governed by French law. In the event of a dispute, the Courts of Bordeaux (Gironde, France) shall have jurisdiction, without prejudice to the mandatory provisions applicable to consumers in their country of residence.
